LOAN CANCELLATIONS


Under certain conditions, a borrower may have all or part of his or her loan cancelled. Cancellation means that a portion or all of the principal borrowed plus accrued interest will never have to be repaid by the borrower.

Due to the many phases of student loans and the number of available types of cancellations, eligibility information is quite extensive. If you believe you may be eligible for a cancellation, please allot ample time to use the tables, links, and forms on this page to help you research your eligibility as efficiently as possible. Canceling your loan will be worth it!

PARTIAL CANCELLATIONS

TOPGeneral Information

    Currently, only Perkins Loans have any provisions for partial loan cancellation (i.e. there are no current provisions for Health Professions Loans or University Loans). All requests for payment postponement and/or partial cancellation must be signed by an authorized official of the employer.

    Partial cancellations are granted on an annual basis for one completed 12-month period of full-time work/service. No cancellation may be allowed for less than a full 12 months of completed work/service although the work/service may be performed for more than one employer/agency. If work/service is performed for multiple employers/agencies, the borrower must provided certified documentation from each employer/agency for the period worked/served.

    Although cancellation may only be granted after 12-months of full-time work/service have already been completed. A borrower should notify Loan Repayment Services as soon as full-time qualifying work/service has been secured to request a postponement of payment. A postponement of payment is issued at the beginning of the 12-month period of full-time work/service in anticipation of the cancellation request at the end of the 12-month period. During postponement, the borrower is not billed for payments and the account is considered current. In most cases, cessation of qualifying work/service before completion of a 12-month period means that the borrower will be responsible for any payments which have accrued since the date of the last payment received or the ending date of the last partial cancellation which was granted. Therefore, it is extremely important for the borrower to notify Loan Repayment Services of any changes in work/service.

    At the end of a completed 12-month period of full-time qualify work/service which is properly documented, the borrower may receive a cancellation of a percentage of the original amount of principal borrowed plus accrued interest. The percentage cancelled each year and the number of years of cancellation that are allowed depends on the type of cancellation. See the section of this page entitled Descriptions of Eligible Work/Service for this information.

    General Policies for Partial Cancellation

    • In order to receive a postponement or partial cancellation, the borrower's account must be current to the beginning date of qualifying work/service.

    • The borrower must apply for partial cancellation of his or her loan by obtaining the appropriate cancellation form from the Loan Management Section.

    • The form must be submitted on time.

    • The borrower must provide any documentation the school requests to show that he/she qualifies for cancellation.

    • No portion of any loan may be cancelled for services the borrower performed before the date the loan was disbursed, or during the same period he or she received the loan.

    • Defaulted loan amounts are not eligible for cancellation unless the only reason for the default was the borrower's failure to file a cancellation request on a timely basis. However, if the school has accelerated the account by the time the borrower files the necessary cancellation request forms, only eligible service performed prior to the date of acceleration can be considered for cancellation. A borrower is not entitled to cancellation for any eligible service performed after the date of acceleration.

    • No repayment made during a period for which a borrower qualified for a cancellation may be refunded, unless the borrower made the payment because of institutional error.

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICEPeace Corps or ACTION Programs

    Applies only to Federal Perkins Loans.

    This type of partial cancellation is for service as a Peace Corps volunteer or a volunteer under the Domestic Volunteer Service Act (ACTION programs). Service in volunteer programs other than Peace Corps or ACTION is not eligible for this type of partial cancellation. For other types of volunteer service, you should check the Deferments page for eligibility.

    For each year that a borrower receives partial cancellation for volunteer service in the Peace Corps or ACTION programs, he/she is considered to have also used one year of military/ACTION deferment.

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICEChild or Family Services

    Applies only to Federal Perkins Loans and National Direct Student Loans made on or after July 23, 1992.

    This type of partial cancellation is for service as a full-time employee of an eligible public or private nonprofit child or family service agency who is providing or supervising the provision of services to high-risk children who are from low-income communities and the families of such children. The main focus of the service must be the children. The borrower cannot be providing services to adults unless the adults are simply family members of the children for whom the services are being provide. (Example: Finding homes for homeless families does not qualify for this type of cancellation as it is the responsibility of the adults in a family to provide a home. While the children, in this case, are greatly benefited, this type of service would actually have been provided to the adult, not the children.)

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICEEarly Intervention Services

    Applies only to Federal Perkins Loans and National Direct Student Loans made on or after July 23, 1992.

    This type of partial cancellation is for service as a full-time qualified professional provider of early intervention services in a public or other nonprofit program under public supervision. Early intervention services are those services defined in section 672(2) of the Individuals with Disabilities Education Act that are provided to infants and toddlers with disabilities.

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICEHead Start

    This type of partial cancellation is for service as full-time staff member of a Head Start program. A full-time staff member is defined as someone who is regularly employed in a full-time professional capacity to carry out the educational part of a Head Start program. The program must operate for a full academic year, or its equivalent, and the borrower's salary may not be more than that of a comparable employee working in the local educational agency.

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICELaw Enforcement or Corrections Officer

    Applies only to Federal Perkins Loans or National Direct Student Loans made on or after November 29, 1990.

    To be eligible for this type of partial cancellation, it must be determined that the borrower's employing agency is eligible and that the borrower's position is essential to the agency's primary mission.

    Eligible employing agency: A local, state, or federal agency is an eligible employing agency if it is public-funded and its activities pertain to crime prevention, control, or reduction or to the enforcement of the criminal law. Such activities include, but are not limited to, police efforts to prevent, control, or reduce crime or to apprehend criminals; activities of courts having criminal jurisdiction and related agencies; activities of corrections, probation, or parole authorities; and problems relating to the prevention, control, or reduction of juvenile delinquency or narcotic addition. Agencies that are primarily responsible for enforcement of civil, regulatory, or administrative laws are ineligible.

    Eligible positions: In order for the borrower's position to be considered essential to the agency's primary mission, he/she must be a full-time employee of an eligible agency and a sworn officer or person whose principal responsibilities are unique to the criminal justice system and are essential in the performance of the agency's primary mission. The agency must be able to document the employee's functions. NOTE: Persons whose official responsibilities are supportive, such as those that involve typing, filing, accounting, office procedures, purchasing, stock control, food service, or building, equipment or grounds maintenance are not eligible for the law enforcement or corrections officer loan cancellation regardless of where these functions are performed. Also, a borrower employed as a public defender does not qualify for cancellation benefits under this provision.

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICENurse or Medical Technician

    Applies only to Federal Perkins Loans or National Direct Student Loans made on or after July 23, 1992.

    To be eligible for this type of partial cancellation, the borrower must be a full-time nurse or medical technician providing health care services.

    Nurse: A licensed practical nurse, a registered nurse, or other individual who is licensed by the appropriate state agency to provide nursing services.

    Medical Technician: A health professional providing specialized medical services who is certified, registered, or licensed by the appropriate state agency in the state in which he or she provides the services. The medical services provided by members of the Allied Health Professions, as well as the medical services provided by physical therapists, speech and language pathologists, and audiologists are included in this definition.

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICEMilitary Service in an "Area of Hostility"

    Applies to all Federal Perkins Loans and National Direct Student Loans made on or after July 1, 1972.

    To be eligible for this type of partial cancellation, the borrower must serve for a complete 12-month period in the U.S. Armed Forces in an area of hostilities or an area of imminent danger that qualifies for special pay under Section 310 of Title 37 of the U.S. Code.

    NOTE: We have been informed that it is unlikely that any one person will be serving in such an area for a complete 12-month period. It is, therefore, suggested that the borrower apply for military deferment (which can be granted in monthly increments) when first stationed in such an area instead of partial cancellation. If the borrower is still stationed in such an area at the end of a complete 12-month period, the borrower should then change the deferment request to a partial cancellation request.

    For each complete 12-month period that a borrower receives partial cancellation for service in the military, he/she is considered to have also used one year of military/ACTION deferment.

    Applies to Federal Perkins Loans and National Direct Student Loans.

    There are several situations which qualify a borrower for partial cancellation for teaching services. In all situations, however, there are some basic qualifications a borrower must meet. Following will be presented the basic qualifications and then specific situations which qualify. Please read the Basic Information and Qualifications first. If you qualify under the Basic Information and Qualifications, proceed to the specific situations to see if your position and your loan qualify.

    Basic Information and Qualifications

    • Teacher cancellation is based on the duties presented in an official position description, not on the position title.

    • The borrower must be teaching in a public or other nonprofit elementary or secondary school system in a state, as recognized by State statute. Elementary education may include educational programs below grade 1 if State law includes these programs as part of the State's elementary education system. There are no cancellation provisions for teaching in postsecondary schools.

    • The borrower must be directly employed by the school system.

    • A teacher is defined as a full-time professional who provides direct and personal services to students for their educational development through
      • direct classroom teaching
      • classroom-type teaching in a non-classroom setting; or
      • educational services to students directly related to classroom teaching such as school librarians or school guidance counselors.
      There is no requirement that a teacher must teach a given number of hours a day in order to qualify as a full-time teacher. The essential criterion for a full-time teacher is whether the employing institution considers the individual as full-time for the purposes of salary, tenure, academic rank, etc.

    • A supervisor, administrator, researcher, or curriculum specialist is not a teacher unless he or she primarily provides direct and personal educational services to students.

    • To receive partial cancellation, the borrower must teach for a complete academic year or two semesters which are complete and consecutive and that generally fall within a 12-month period.

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICESpecific Teaching Situations

    • TO SPECIFIC TEACHING SITUATIONS Teacher who is not certified or licensed: It is not necessary for a teacher to be certified or licensed to receive cancellation benefits. However, the employing institution must consider the individual to be a full-time professional for the purposes of salary, tenure, retirement benefits, etc.
    • TO SPECIFIC TEACHING SITUATIONS Teacher's aide: In order to be eligible, a teacher's aide must meet the definition of a "full-time teacher", must have a baccalaureate degree, and be a professional recognized by the State as a full-time employee rendering direct and personal services in carrying out the instructional program of an elementary or secondary school.
    • TO SPECIFIC TEACHING SITUATIONS Social worker: A social worker, working full-time in a school setting, providing direct and personal services to students could be eligible for teacher cancellation if the services performed relate to the student's interaction with his/her school environment.
    • TO SPECIFIC TEACHING SITUATIONS School psychologist: A psychologist working full-time in a school setting is eligible for "handicapped" or "special education" cancellation if a majority of the students counseled meet the statutory definition.
    • TO SPECIFIC TEACHING SITUATIONS Illness or pregnancy: If a borrower is prevented, due to illness or pregnancy, from fulfilling his/her obligation to complete the academic year, cancellation may be allowed if the borrower has completed the first half of the academic year and begun teaching the second half and the hiring authority considers the borrower, for purposes of salary increment, tenure, and retirement, to have fulfilled his/her contract for the academic year.

    TO SPECIFIC TEACHING SITUATIONSSituations Which DO NOT Qualify:

    • Volunteer teacher.
    • Member of a Cooperative Education Service.
    • Teaching services overseas, including schools operated by the Armed Forces of the United States, schools operated overseas by the State Department, and overseas mission schools.


    TO SPECIFIC TEACHING SITUATIONSFull-time Teacher in a "Low Income" School

    This type of partial cancellation applies to borrowers teaching in a school serving a high concentration of low-income families.

    To be considered for this type of partial cancellation, the borrower must meet all criteria listed under Basic Information and Qualifications plus be teaching in a school that is listed in the Directory of Designated Low-Income Schools which is released annually by the Federal government. The Directory is not currently accessible from the web. For Information on whether a specific school qualifies contact the Loan Servicing Department at 626-7004.

    Subsequent Year Provision: Formerly, Federal regulations required that a school be listed in the Directory each year in order for a borrower to receive partial cancellation. The 1992 Federal Amendments alter this requirement. If you receive partial cancellation one year for service in a school which is listed in the Directory, but the next year this same school is not listed, you are now still eligible to receive partial cancellation at this same school based on your prior year qualification.

    TO SPECIFIC TEACHING SITUATIONS
    Full-time Teacher of Handicapped Students (for loans made before7/23/92)

    To be considered for this type of partial cancellation, the borrower must meet all criteria listed under Basic Information and Qualifications plus the majority of the students being taught must be considered handicapped according to the definition of "handicapped" as determined by Federal guidelines. Also, the majority of the students being taught must be children; the majority cannot be adults.

    To be considered for this type of partial cancellation, the borrower must meet all criteria listed under Basic Information and Qualifications plus the majority of the students being taught must be infants, toddlers, children, or youth with disabilities as defined in section 672(2) of the Individuals with Disabilities Education Act.

    TO SPECIFIC TEACHING SITUATIONSFull-time Teacher in a Shortage Area "Field of Expertise"

    To be considered for this type of partial cancellation, the borrower must meet all criteria listed under Basic Information and Qualifications plus be teaching in the fields of mathematics, science, foreign languages, or bilingual education or in any other "field of experise" that is determined by a state education agency to have a shortage of qualified teachers in that state. The majority of the classes being taught must be in the borrower's field of expertise.

    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICEAmeriCorps

    AmeriCorps is the national service program that allows people of all ages and backgrounds to earn help paying for education in exchange for a year of service. After completing one year of full-time service (from 10 to 12 months), AmeriCorps members receive an education voucher worth $4,725. The voucher can be used to cover future costs of college or vocational school and to pay back student loans. For details on how awards are earned, may be spent, and the process of actually receiving and using them, visit the AmeriCorps website or call the toll free number 1-800-942-2677.

    Service with AmeriCorps does not entitle a borrower to a partial cancellation unless he/she meets the specific criteria of one of the eligible partial cancellation types. This is a loan payback program.


    TO DESCRIPTIONS OF ELIGIBLE WORK/SERVICETeach For America

    Teach For America is the national teacher corps of outstanding recent college graduates of all academic majors and cultural backgrounds who commit two years to teach in under-resourced urban and rural public schools.

    If a borrower meets the specific criteria for teacher cancellation, he/she may receive partial cancellation as a teacher; otherwise, since Teach For America is an AmeriCorps program, the borrower must follow the procedures for AmeriCorps loan payback.

    TOPAPPLYING -- WHAT TO DO WHEN

    If you have read the General Information and have already checked Eligible Work/Service and Eligible Loans for your type of employment/service and believe that you are in a qualifying situation, you should now apply for either a Postponement of Payment or a Partial Loan Cancellation depending on how long you have already worked/served.

    If you are just beginning qualifying employment/service or have been in a qualifying position for less than a complete 12-month period, you will be applying for a Postponement of Payment. To apply for postponement, you should print or request the appropriate type of forms for your work/service and return to our office.

    If you have already completed a 12-month period of qualifying employment/service, you will be applying for a Partial Loan Cancellation. To apply for a partial cancellation, you should print or request the appropriate type of forms for your work/service and return as soon as possible.

    If you have already completed a 12-month period of work/service and are still working/serving in a qualifying position, you will be applying for both partial cancellation and postponement. Print or request the appropriate forms for your work/service and complete each subsequent year until your loan is completely cancelled, you have reached the maximum allowable cancellation, or you no longer work/serve in a qualifying position.

    NOTE: The appropriate sections of request forms must be completed in full as outlined above. Each form must be signed by the borrower and an authorized official of the employer or contracting agency.

    TOPGeneral Information

    There are three situations which might qualify a borrower's student loan for total cancellation:


    BACK TO TOTAL CANCELLATIONSBankruptcy Total Cancellation


    FOR BANKRUPTCIES FILED PRIOR TO OCTOBER 1, 1998

    If a borrower's student loans have been in repayment for less than 7 years, the student loans are non-dischargeable. This means that, after the bankruptcy proceeding has been completed and our office receives the Notice of Discharge from the Bankruptcy court, the loans will go back into repayment status.

    If a borrower's student loans have been in repayment for more than 7 years, or if a borrower's student loans have been discharged under the Hardship provision, the student loans will be discharged and the balance due will be written-off after the bankruptcy proceeding has been completed and our office receives the Notice of Discharge from the Bankruptcy court.

    FOR BANKRUPTCIES FILED AFTER OCTOBER 1, 1998

    Due to recent changes in 1998 Higher Education Reauthorization and the US Bankruptcy Code, student loans can generally NOT be discharged by bankruptcy regardless of the amount of time the loan has been in repayment. Your attorney can give you more information on this exemption to discharge.


    BACK TO TOTAL CANCELLATIONSDeath Total Cancellation

    In the event of the borrower's death, the entire remaining balance of the student loans will be cancelled. The family should provide a death certificate or some other documentation to certify the death.


    BACK TO TOTAL CANCELLATIONSDisability Total Cancellation

    The entire remaining balance of the student loans may be cancelled at the request of a borrower if the lending institution determines that the borrower has become permanently and totally disabled. Permanent and total disability is defined as the inability to work and earn money or attend school because of a medically determined impairment, if that impairment is expected to continue for an indefinite period or to result in death. Receipt of Social Security disability benefits does not automatically qualify a borrower for permanent and total disability cancellation.

    BACK TO ORIGINAL LOCATION "Handicapped" students (for loans made before 7/23/92):
    Children who require special education and related services because they are:
    • mentally retarded,
    • hard of hearing,
    • deaf,
    • speech impaired,
    • visually handicapped,
    • seriously emotionally disturbed,
    • orthopedically impaired,
    • specific learning disabled, or
    • otherwise health impaired.

    Full-time teaching of handicapped students who are homebound (non-classroom instruction) in a school system would be considered teaching of handicapped.

    BACK TO ORIGINAL LOCATION High-risk children: Individuals under the age of 21 who are low-income or at risk of abuse or neglect, have been abused or neglected, have serious emotional, mental, or behavioral disturbances, reside in placements outside their homes, or are involved in the juvenile justice system.
    BACK TO ORIGINAL LOCATION Low-income community: A community in which there is a high concentration of children eligible to be counted under Chapter 1 of Title I of the Elementary and Secondary Education Act of 1965, as amended.
    BACK TO ORIGINAL LOCATION Infants, toddlers, children, or youth with disabilities (for loans made on or after 7/23/92):

    Infants and toddlers with disabilities: Infants and toddlers from birth to age 2, inclusive, who need early intervention services for the following specified reasons as defined in section 672(1) of the Individuals with Disabilities Education Act:

    • they are experiencing developmental delays, as measured by appropriate diagnostic instruments and procedures in one or more of the following areas: cognitive development, physical development, language and speech development, pyschosocial development, or self-help skills; or
    • they have a diagnosed physical or mental condition which has a high probability of resulting in developmental delay.

    The term infants and toddlers with disabilities may also include, at a state's discretion, individuals from birth to age 2, inclusive, who are at risk of having substantial developmental delays if early intervention services are not provided.

    Children and youth with disabilities: Children and youth from ages 3 through 21, inclusive, who require special education and related services because they have disabilities as defined in section 602(a)(1) of the Individuals with Disabilities Education Act. Section 602(a)(1) defines "handicapped children" as children who are mentally retarded, hard of hearing, deaf, speech or language impaired, visually handicapped, seriously emotionally disturbed, orthopedically impaired, or other health impaired children or children with specific learning disabilities who by reason thereof require special education and related services.

    BACK TO ORIGINAL LOCATION Qualified professional provider of early intervention services:
    A provider of services, as defined in section 672(2) of the Individuals with Disabilities Education Act, are developmental services that --

    • are provided under public supervision;

    • are provided at no cost except where federal or state law provides for a system of payments by families, including a schedule of sliding fees;

    • are designed to meet a handicapped infant's or toddler's developmental needs in any one or more of the following areas:
      • physical development,
      • cognitive development,
      • language and speech development,
      • phychosocial development, or
      • self-help skills;

    • meet the standards of the state, including the requirements of this part;

    • include:
      • family training, counseling, and home visits,
      • special instruction,
      • speech pathology and audiology,
      • occupational therapy,
      • physical therapy,
      • phychological services,
      • case management services,
      • medical services only for diagnostic or evaluation purposes,
      • early identification, screening, and assessment services, and>
      • health services necessary to enable the infant or toddler to benefit from the other early intervention services;

    • are provided by qualified personnel, including:
      • special educators,
      • speech and language pathologists and audiologists,
      • occupational therapists,
      • physical therapists,
      • phychologists,
      • social workers,
      • nurses, and
      • nutritionists; and

    • are provided in conformity with an individualized family service plan adopted in accordance with Section 677 of the Individuals with Disabilities Education Act.
    BACK TO ORIGINAL LOCATION School serving a high concentration of low-income families:
    Defined by the Secretary of Education as a school with more than 30% of its enrollment counted in the funding formula of Title I of the Elementary and Secondary Education Act of 1965, as amended. The school must be a public or other nonprofit private elementary or secondary school that is located in a school district of a local educational agency that is eligible for assistance under Title I of the Elementary and Secondary Education Act of 1965, as amended. All elementary and secondary schools operated by the Bureau of Indian Affairs (BIA) or operated on reservations by Indian tribal groups under contract with the BIA qualify as schools serving low-income students.

    All schools must have been in existence for one previous year before they may be listed regardless of the percentage of Title I students. If a school was previously in existence but now under a different name and having the exact same student population as before, the school will be considered.

    Questions pertaining to the eligibility of an elementary or secondary school to be listed in the Directory should be directed to the appropriate State agency. If you do not know the State agency you should contact, you may contact Loan Repayment Services to assist you in this determination.

    Section 672 (3) - The term "developmental delay" has the meaning given such term by a State under section 676(b)(1).

    Section 672 (4) - The term "Council" means the State Interagency Coordinating Council established under section 682.

    Section 676 - Definition of "Lead Agency" -

    1. In General - A statewide system of coordinated, comprehensive, multidisciplinary, interagency programs providing appropriate early intervention services to all handicapped infants and toddlers and their families shall include the minimum components under subsection (b).

    2. Minimum Components - The statewide system required by subsection (a) shall include, at a minimum -
      . . .
      1. a single line of responsibility in a lead agency designated or established by the Governor for carrying out -
        1. the general administration, supervision, and monitoring of programs and activities receiving assistance under section 673 to ensure compliance with this part,
        2. the identification and coordination of all available resources within the State from Federal, State, local and private sources,
        3. the assignment of financial responsibility to the appropriate agency,
        4. the development of procedures to ensure that services are provided to handicapped infants and toddlers and their families in a timely manner pending the resolution of any disputes among public agencies or service providers,
        5. the resolution of intra- and interagency disputes, and
        6. the entry into formal interagency agreements that define the financial responsibility of each agency for paying for early intervention services (consistent with State law) and procedures for resolving disputes and that include all additional components necessary to ensure meaningful cooperation and coordination,
